General Terms and Conditions (as of May 6, 2023)

§1 Scope / Contracting Party

The following terms and conditions apply exclusively to all contracts between Hatico Mode GmbH, Falkenbergerstraße 7, 95643 Tirschenreuth, and consumers.

A consumer is any natural person who concludes a legal transaction for a purpose that can be attributed neither to their commercial nor their independent professional activity.

§2 Conclusion of Contract

The products offered in our shop do not constitute legally binding offers; they are merely a non-binding online catalog. By clicking the "Buy" button, you submit a binding purchase offer. The automated confirmation of the order does not yet constitute acceptance of the contract. The purchase contract is concluded upon shipment of the goods.

§3 Availability of Goods / Delivery Time

The delivery of the goods will take place according to the agreements made with you. Partial deliveries are permissible. Binding delivery and service deadlines must be agreed upon in writing and require our approval. Otherwise, delivery and service deadlines are non-binding.

§4 Liability for Defects

1. Hatico Mode GmbH is liable without limitation for intent. For gross and simple negligence, Hatico Mode GmbH is only liable in the event of injury to life, body, health, or a material contractual obligation. Material contractual obligations are those whose fulfillment is necessary to achieve the purpose of the contract and on whose fulfillment the customer has relied and could reasonably rely.
   2. In the event of a slightly negligent breach of material contractual obligations, the seller's liability is limited in amount to the foreseeable, typically occurring damage.
   3. The foregoing limitations of liability also apply in favor of the seller's legal representatives and vicarious agents.
   4. Liability under the Product Liability Act remains unaffected.

§5 Payment Terms

Hatico Mode GmbH accepts the payment methods displayed during the order process.

When paying via PayPal, credit card via PayPal, direct debit via PayPal, or – if offered – "purchase on account" via PayPal, we transmit your payment data to PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter "PayPal") as part of the payment processing. PayPal reserves the right to carry out a credit check for the payment methods credit card via PayPal, direct debit via PayPal, or – if offered – "purchase on account" via PayPal. PayPal uses the result of the credit check regarding the statistical probability of payment default to decide whether to provide the respective payment method. The credit check may contain probability values (so-called score values). Insofar as score values are included in the result of the credit check, they are based on a scientifically recognized mathematical-statistical procedure. Address data, among other things, is included in the calculation of the score values.

For the payment method "SOFORT," payment processing is carried out by the payment service provider SOFORT GmbH, Theresienhöhe 12, 80339 Munich (hereinafter "SOFORT"). To pay the invoice amount via "SOFORT," the customer must have an online banking account enabled for "SOFORT" with a PIN/TAN procedure, legitimize themselves accordingly during the payment process, and confirm the payment instruction to "SOFORT." The payment transaction is then immediately carried out by "SOFORT" and the customer's bank account is debited. §6 Delivery Conditions / Shipping Costs

Shipping by Hatico Mode GmbH only takes place within the European Union. Unless otherwise agreed, delivery will be made to the delivery address specified by the customer within the delivery area. You can find the corresponding shipping costs here (under the "Shipping Costs/Returns" section).

§7 Warranty

The customer's warranty claims for defects in the purchased goods are governed by statutory provisions.

§8 Vouchers

Vouchers may be subject to quantity and/or time restrictions. These restrictions will be indicated in the description. Unless otherwise specified regarding the period of validity, vouchers are valid until the end of the third year after the year of purchase. Vouchers can only be redeemed during the order process. Subsequent crediting is not possible. Vouchers will not be paid out or accrue interest.

§9 VAT Refund

Hatico Mode GmbH does not offer VAT refunds for goods independently exported to third countries.

§10 Retention of Title

The delivered goods remain the property of Hatico Mode GmbH until full payment has been received.

§11 Final Provisions

All contracts between Hatico Mode GmbH and the customer are subject to the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

§12 Alternative Dispute Resolution (Art. 14 Para. 1 ODR-VO, §36 VSBG)

Participation in dispute resolution proceedings before a consumer arbitration board is not mandatory. Hatico Mode GmbH will therefore not participate in a dispute resolution procedure.
